Painter fined for unregistered exhibition requested to destroy paintings

Mr. Bui Quang Vien was administratively sanctioned with an amount of VND25 million ($1,100) according to the provisions of Clause 4, Article 19 of Decree No. 38/2021/ND-CP.

(Ngay Nay) – This sanctioning decision was signed by Mr. Duong Anh Duc, Vice Chairman of Ho Chi Minh City People’s Committee to “Sanction for administrative violations against Mr. Bui Quang Vien, born in 1979, who is an individual exhibitor of his painting, violation location No. 271/5 Nguyen Trong Tuyen, Ward 10, Phu Nhuan District, Ho Chi Minh City.”

According to this decision, Mr. Bui Quang Vien was sanctioned for: “Having committed administrative violations: holding exhibitions in Vietnam without a license in accordance with regulations. Specifically, at the time of inspection, Mr. Bui Quang Vien exhibited 29 paintings at the Alpha Art Station gallery at 271/5 Nguyen Trong Tuyen, Ward 10, Phu Nhuan District, Ho Chi Minh City without permission according to regulations.”

In addition, Mr. Bui Quang Vien must destroy 29 exhibited paintings according to the provisions of point c, clause 8, Article 19 of Decree No. 38/2021/ND-CP to “remediate the consequences.”

Ho Chi Minh City People’s Committee has assigned the Ho Chi Minh City Department of Culture and Sports to implement the decision.

Bui Quang Vien’s exhibition takes place on July 15-30 at the above address. Mr. Bui Quang Vien said he had received a phone notification from the Ho Chi Minh City Department of Culture and Sports about the incident, but he had not yet received a sanction decision.

According to the regulations, when the person who has been fined for an administrative violation receives the sanctioning decision, he or she will have the right to complain or initiate an administrative lawsuit against that decision. Mr. Bui Quang Vien said he will exercise the right to complain or sue to request the cancellation of the above sanctioning decision.

Sharing more with Ngay Nay, Mr. Bui Quang Vien said that this is his first painting exhibition, so he did not pay attention to the regulations requiring a license from the management agency. “I only display my paintings for the purpose of showing off my paintings to my friends after many years of silently drawing, and there is no other purpose. So the sanction made me very surprised,” Mr. Vien said.
