Vietnamese legislator Luu Binh Nhuong, rare voice for justice

Luu Binh Nhuong – Deputy Head of the Civil Volunteers Committee

It is no wonder that Luu Binh Nhuong, one of the few former members of Vietnam’s National Assembly, dares to speak out with integrity. He is Vice Dean of Faculty of Economic Law, Hanoi Law University. He is a man of legal background, and most importantly, he dared to say the right thing in a society full of lies.

Luu Binh Nhuong served as a member of the Vietnamese rubber-stamped parliament of the 14th term under the leadership of Chairwoman Nguyen Thi Kim Ngan. He once strongly condemned the conviction of Ho Duy Hai, a case of injustice and blatant violation of criminal procedures, by Nguyen Hoa Binh, member of the Party Central Committee, Chief Justice of the Supreme People’s Court. The case was so blatant that Nguyen Hoa Binh accepted the evidence bought in the market, to sentence the guy to death without having solid evidence.

The Ho Duy Hai case is a legal stain, exposing a dirty face of the regime. Luu Binh Nhuong spoke out for justice as a way to wash the face of the Communist Party, but the Party was not grateful, on the contrary, they did not want him to have a public voice anymore. After the Ho Duy Hai case, in the election of the 15th National Assembly in 2021, he was not allowed to be included in the candicate list while Mr. Nguyen Hoa Binh became a member of the Politburo. This action shows that the Communist government always ignores righteous voices and sided with evil. That is the message that the Communist Party sends to the people.

Although the Communist Party doesn’t like Luu Binh Nhuong, they need people like him, the purpose is to create conflicting voices, to show the world that the Communist Party also allows people with opposing opinions to speak like in democratic countries. In fact, voices like Luu Binh Nhuong cannot be counted on the fingers. He, even if he spoke out, was nothing compared to the National Assembly of nearly 500 legislators who obey the party’s instructions.

Today, Luu Binh Nhuong is no longer a member of the National Assembly, but he is currently the Deputy head of the National Assembly’s Committee for interaction with voters. He also contributed his right words to the Vietnamese judiciary, although his voice was lost in the jungle of people who only nodded to the Party.

Recently, Mr. Luu Binh Nhuong spoke out about the case of teacher Le Thi Dung, who was sentenced to 5 years in prison by the People’s Court of Hung Nguyen district, Nghe An province, just for wrongly spending VND45 million ($1,980). This is a case of injustice, it speaks of a judicial system of tools, designed to let the powerful to punish those they do not like. A rotten judiciary.

Mr. Luu Binh Nhuong pointed out 2 unusual points, showing that the People’s Court of Hung Yen district, Nghe An province, made the following mistakes:

First, Dung was held in detetion in one year before being taken to the court while the law stipulates that the time limit for temporary detention of the accused for investigation shall not exceed two months for less serious crimes, and no more than three months for other serious crimes, not more than four months for very serious crimes and especially serious crimes. Thus, the detention of Ms. Dung for one year before going to trial, violates the detention time limit or not?

Secondly, in the indictment of the judgment, it is said that Ms. Dung abused her position and authority in the performance of her official duties, with a wrongful payment of nearly VND45 million within 5 years, of which in some years it was just over VND300,000.

The fact that the People’s Court of Hung Nguyen district sentenced Ms. Dung to 5 years in prison for wrongly spending nearly VND45 million shows that this is an unhuman judgment, compared to other sentences, such as the cases of trillions and extremely long-term consequences, it is clear that the nature and extent of a case like this is disproportionate (because it is in the same socialist legal system).

Luu Binh Nhuong only said that, however, through his statement also clearly showed that the Vietnamese legal system is only a judicial tool. Those in power are using the law to arbitrarily impose crimes, the purpose is to punish and take revenge on those who make them unhappy.
